Martin & Seibert, L.C. shareholder and director of litigation E. Kay Fuller was selected as a member of the faculty for the 2009 DRI Insurance Coverage & Practice Symposium. She spoke on emerging trends in coverage litigation nationally and provided practitioners with her insights as to policyholder attempts to stretch coverage to fit traditionally non-covered events.
Her presentation focused upon a number of decisions of first impression in state and federal courts across the country that impacted insurers on a coverage and indemnification basis - some of which also serve as the basis for extra-contractual litigation. Fuller noted for those in attendance that exclusions are being challenged much more frequently as are amendatory endorsements as well as attempts to expand the definition of insureds so as to trigger coverage. Fuller also cautioned insurers that taking "shortcuts" due to the economic downturn could later prove costly if insurers ultimately take inconsistent positions on coverage issues.
